Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between you and Lumon LLC (“Lumon LLC,” “we,” “us,” or “our”), the company that operates MunchCard (the “Service”), including the MunchCard mobile app, the munchcard.app website, and related features.

By creating an account, joining the waitlist, or otherwise accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

MunchCard is a creator-powered dining-rewards service. Diners discover participating restaurants through creator reels, claim a promotional offer (a “promo”), receive a MunchCard, and earn rewards that are verified through card transactions when they dine. Creators who share a promo may earn a commission on verified visits.

• Rewards are offers made available by participating restaurants and applied when an eligible, verified visit occurs.
• Creator commissions are amounts payable to creators for visits attributable to a promo they shared, once those visits are verified.
• The MunchCard is a payment card used to verify visits and apply rewards (see Section 5).

You must be at least 18 years old and a resident of the United States to use the Service. By using the Service, you represent that you meet these requirements and that the information you provide is accurate and complete. Certain features (including card issuance) may require additional verification.

You are responsible for the activity that occurs under your account and for keeping your login credentials secure. Notify us promptly at support@munchcard.app if you suspect unauthorized use of your account. We may suspend or close accounts that violate these Terms or that we reasonably believe present a risk of fraud or harm.

The MunchCard payment card and related issuing, processing, and banking services are provided by one or more third-party banking and card-issuing partners, not by Lumon LLC directly. Your use of the card is also subject to the cardholder agreement, terms, and privacy notices of those partners, which you may be required to accept separately.

• Rewards are applied to qualifying transactions made with your MunchCard at participating restaurants and are subject to the terms of each promo.
• A visit is treated as “verified” when a qualifying card transaction is matched to a claimed promo. We may decline to apply a reward where a transaction cannot be verified or appears fraudulent.
• Rewards and promos have no cash value except as required by law, may expire, and may be modified or withdrawn by the participating restaurant or by us.

You agree not to:

• use the Service for any unlawful, fraudulent, or deceptive purpose, including manufacturing or staging transactions to obtain rewards or commissions;
• interfere with, disrupt, reverse-engineer, or attempt to gain unauthorized access to the Service or its systems;
• misrepresent your identity, impersonate others, or provide false verification information; or
• use the Service in a way that violates the rights of restaurants, creators, other users, or any third party.

We may investigate suspected abuse and may withhold or reverse rewards, commissions, or payouts associated with it.

If you participate as a creator, you may earn a commission on visits that are verified as attributable to a promo you shared. You agree to:

• share only accurate, non-misleading content and to disclose your relationship with MunchCard where required by law (including applicable advertising and endorsement rules);
• provide accurate payout and, where required, tax information; and
• not engage in self-dealing, fake visits, or other activity designed to inflate commissions.

Commission rates, eligibility, and payout timing are described in-product and may change. Payouts are made only on verified visits and may be delayed, withheld, or reversed in cases of suspected fraud, chargebacks, or breach of these Terms.

If you participate as a restaurant or campaign sponsor, you are responsible for the rewards you offer and for honoring qualifying visits in accordance with the promo. You authorize us to facilitate reward application, creator commissions, and related reporting for your campaigns. Campaign budgets, fees, and settlement terms are set out in your separate campaign or merchant agreement, which controls in the event of a conflict with these Terms.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that rewards, promos, or restaurant offers will always be available.

To the maximum extent permitted by law, Lumon LLC and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amounts you paid us in the twelve months before the claim or (b) US $100.

You may stop using the Service at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms, if required by a partner or by law, or to protect the Service or its users. Upon termination, your right to use the Service ends, though certain provisions (including Sections 9 through 13) survive.

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means and update the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State in which Lumon LLC is organized (the State of Delaware), without regard to its conflict-of-laws rules. The exclusive venue for disputes not subject to arbitration will be the state and federal courts located in that State, to the extent permitted by applicable law.
